Competition Law in Finland and the Nordic Region: Evolution, Systems and Peculiarities
Abstract: This lecture explores the evolution and unique characteristics of the Finnish competition law system, situated within the broader context of the Nordic legal tradition. The Finnish judicial model of enforcement (“dual-institutional model”) is a rarity among Member States, which have almost all adopted an administrative model of enforcement. Central to the discussion is the Finnish dual-institutional design, where the Finnish Competition and Consumer Authority (FCCA) investigates and proposes sanctions, while the Market Court—a specialized judicial body—retains the power to impose fines and prohibit mergers.
The lecture will also provide a brief comparative overview of the competition law systems of the other Nordic countries and highlight regional Nordic peculiarities, such as the robust tradition of cross-border cooperation between authorities and the specific national provisions on “competition neutrality,” which ensure that public-sector business activities do not gain unfair advantages over private competitors.
About the Speaker: Pauliina Scarabattoli is a PhD Researcher at the Law department of the European University Institute. Her research focuses on the enforcement against exploitative abuses of dominance under EU competition law. Prior to joining the EUI, Pauliina has worked as a senior adviser in the antitrust enforcement unit of the Finnish Competition and Consumer Authority and as a legal counsel for a Helsinki-based international law firm.
Pauliina holds an LLM in Comparative, European and International Laws from the EUI, a master’s degree in law from the University of Helsinki and a Postgraduate Diploma in Economics for Competition Law from King’s College London.
